Pendente Lite Support in Virginia: Temporary Orders Explained

Pendente lite means while litigation is pending. In a Virginia divorce, a temporary financial order can address immediate issues without resolving every question in the final decree. The first task is to distinguish requested temporary relief from an order already entered.

Identify the temporary issue precisely

List the immediate problem: support, housing-related costs or another question counsel says can be addressed during the case. Gather the complaint, any motion, hearing notices and existing orders. Keep proposed amounts clearly labelled as proposals.

A useful working budget records the expense, period, source and person currently paying it. Do not treat every listed household cost as automatically recoverable through temporary relief.

Use the statute governing pending cases

Virginia Code § 20-103 authorises specified orders during pending divorce, custody or visitation proceedings. Temporary relief is not the same inquiry as the final spousal-support determination or the final allocation of marital property and debt.

The applicable provision, any relevant calculation and the court’s findings need review for the particular case. This guide intentionally does not supply a universal temporary-support formula or promise that a standard percentage applies.

Prepare records that explain present circumstances

Keep current pay records, account information and documentation for the expenses in dispute. Note recent changes such as a move, a coverage change or altered childcare arrangements. Mark estimates and the date each figure was checked.

For example, a monthly budget containing both a current rent payment and a former household mortgage can require explanation. A dated note showing who occupies which home and who pays each bill is more useful than an unexplained total.

Track the order’s scope and next steps

After an order is entered, keep the signed version and identify its payment, notice and hearing provisions. Ask how it interacts with existing orders and what process applies if circumstances change. Do not assume a temporary ruling guarantees the same final result.

This is an explanation of terminology and preparation. TroofLaw does not draft motions, calculate a personal support entitlement or tell a reader to stop paying an existing obligation while awaiting temporary relief.
