Changing a Virginia Child Support Order: Records and Process
A new income figure or parenting schedule does not itself replace a child-support order. Before seeking a change, identify the operative order and whether the case is being handled through a court, the Department of Social Services or both.
For a sense of the figures involved, see how much child support is at common incomes.
Find the operative order first
Keep a complete signed copy and any later amendments. Note the issuing court or agency, case number, current amount and payment route. A proposed worksheet or a parent’s spreadsheet is not the same document as the order currently in force.
Make a timeline of changes you want a qualified reviewer to consider: income, employment-related childcare, coverage, parenting arrangements or other relevant circumstances. Identify dates rather than simply stating that things are different now.
Choose the correct review route
Virginia Code § 20-108 addresses revision of child-related decrees, including limits on retroactive modification. DCSE also publishes information about review and adjustment of support orders. The appropriate route depends on the order and case history; an agency review and a court motion are not interchangeable labels.
Ask which body has authority, what paperwork is required and how notice must be given. Do not assume an online request has changed the order or secured a particular effective date.
Keep payment and change evidence separate
Retain payment histories and documentation of the claimed change. Explain missing or disputed payments without altering the underlying records. A disagreement about past payments can be different from the question whether future support should change.
For example, losing overtime and receiving a new insurance premium may affect the information to review, but neither fact alone tells this website whether modification is justified or what amount should result.
Ask about timing before delaying
Effective dates and retroactivity can make delay consequential. Obtain prompt advice about the particular order rather than relying on an expectation that a later recalculation will erase earlier amounts. Keep proof of filing, service and agency communications where applicable.
Continue to distinguish the existing obligation from requested relief. This guide does not authorise a private payment change, determine whether a material change exists or submit an adjustment request on a reader’s behalf.
