Child support inputs
Health Insurance Costs in Virginia Child Support
An insurance deduction on a payslip may cover several people and several kinds of benefits. Before entering a health-coverage amount into Virginia child-support paperwork, identify what the deduction actually buys and which children it concerns.
Start with the coverage document
Collect the current benefit election or insurer/employer explanation, premium statement and the names or categories of people covered. Note the effective date and payment frequency. A family payroll deduction may combine costs that are not interchangeable for a support worksheet.
Keep medical, dental or other coverage labels clear. If an employer changes plan rates during the year, retain the old and new figures with their start dates so that nobody mistakes one period’s cost for another.
Check the child-related cost under the statute
Virginia Code § 20-108.2(E) addresses health-care coverage costs in the support calculation. Read the current provision and worksheet instructions before treating the entire family premium as a cost for the children in the case. Ask the plan administrator for an explanation if the relevant cost cannot be identified from the statement.
A rough division by the number of family members is not something to assume is the legal method. Mark an unresolved allocation as a question rather than presenting an estimate as a verified premium amount.
Keep premiums and unpaid medical bills separate
A recurring coverage premium is different from a bill for treatment or an unreimbursed expense. Create separate records for the premium, an explanation of benefits, the provider’s charge and payments or reimbursements. Preserve any existing order that addresses how medical expenses are shared.
For example, a dentist’s bill is not proof of the monthly cost of dental coverage. Keeping these records apart makes it easier to explain whether a question concerns a worksheet input, an expense-sharing provision or an alleged unpaid obligation.
Review changes with the order in view
Ask what happens if employment or available coverage changes, and which party is responsible for providing information. Do not assume changing insurance automatically changes the support amount or cancels another duty in the order.
