SCRA Stays in a Virginia Divorce: What the Request Addresses

A military assignment can interfere with a court appearance. A Servicemembers Civil Relief Act stay addresses that participation problem; it is not a divorce exemption. This guide explains the information to identify before asking qualified counsel about a pending Virginia case.

Identify the procedural problem

Start with the actual paper received: a complaint, summons, hearing notice or an existing order. Note the court, case number, hearing date, how the paper arrived and when it was received. A request involving a case with notice is different from a default-judgment issue. Do not assume an internet explanation of one SCRA protection covers every procedural situation.

Keep a chronology of deployment orders, training commitments and court notices. The purpose is to explain the conflict accurately, not to decide for yourself that a response is unnecessary.

What the stay provision asks about

50 U.S.C. § 3932 addresses civil proceedings where the servicemember has notice. Its initial stay provisions connect the request to military duty materially affecting appearance and require communications about availability and commanding-officer confirmation. When its statutory conditions are met, the initial stay is at least 90 days. Additional delay has a separate procedure.

A useful question for a military legal-assistance office or Virginia lawyer is which statutory provision fits the present stage of the case. Avoid describing any military absence as an automatic indefinite postponement.

Organize communications without exposing sensitive details

Keep the court deadline visible while seeking advice. Ask what information must be provided, how a request must be filed and whether a hearing is still scheduled. Protect operational and personal information: confirm how the court wants duty-related material submitted rather than posting orders or a commanding officer’s contact details online.

For example, a training conflict that ends before a scheduled hearing raises different practical questions from an assignment with no confirmed return date. Record what is known and mark uncertain dates rather than making an unsupported promise of availability.

A stay is not a decision on the divorce

Postponing participation does not itself decide grounds, support, property division or parenting arrangements. Keep existing orders and payment records separate from the stay paperwork. Ask about each continuing obligation and any separate relief needed; do not treat an application as permission to stop complying.

Before relying on a deadline calculation, obtain case-specific advice. This website does not file stay requests, contact commanding officers or determine whether an application satisfies federal law.
